The petitioner alleges that the pradhan, Tatla-II Gram Panchayat failed and neglected to effect water connection to his premises situated at Plot No. 193 corresponding to Khatian No. 247 measuring about 17 decimals within Village -Pumlia.

The Inspector-in-Charge Chakdah Police Station, Nadia has filed a detailed report. The same is taken on record.

It appears that the petitioner filed an application for grant of water connection before the the Tatla-II Gram Panchayat. The petitioner also applied for connection from the West Bengal State Electricity Distribution Company, Chakdah.

During enquiry by the police, it was found that the Plot No. 193 at Mouza 14 No. Pumlia was a vested land and the petitioner was illegally trying to take possession of the same.

The pradhan, Tatla-II Gram Panchayat desired to take possession of the land and approached the Sub-Divisional Officer, Kalyani, Nadia for recovery of the same. The pradhan wanted to use the said land for developmental work and to establish an educational institution and Anganwadi centre. Local persons also informed the police authorities that the petitioner was in illegal possession of the said land in question.

The Block Land & Land Reforms Officer, Chakdah, Nadia by a notice asked the petitioner to vacate the said land vide office Memo No.

636/BL&LRO/CKD/2021 dated July 16, 2021. The petitioner was also asked by the authority to produce documents in support of his occupation of government land. The petitioner did not submit such document.

Thus, when the above material facts which surfaced pursuant to police enquiry have been suppressed by the petitioner in the writ petition, no directions can be passed upon the panchayat authorities to install a water line over the disputed premises.

The writ petition is disposed of without any orders.

However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
