Kausik (Rejected) CRM (M) 2523 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Shibdaspur Police Station Case No. 101 of 2025, dated 13.06.2025 under section 61(2) of the BNS, 2023 read with section 27(7)(i) of the Arms Act, 1959;

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 172 days and he has been arrested for possession of one country made pistol and a single ammunition. On any stringent condition, prayer for bail has been advanced before this Court.

Learned advocate for the State submits that on the basis of the statement of the present petitioner another accused was arrested from whom there were seizures of ammunition. From the further statement of the said co-accused country made pistol and ammunitions were recovered. It has also been stated that the petitioner has antecedents.

Be that as it may, having considered the nature of the stage of the case, at this stage I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner is rejected.

However, the State is directed to take steps for overcoming the stage of consideration of charges within next 30 days and within 60 days thereafter State would take steps for examining the seizure list witnesses.

Petitioner would be at liberty to approach this Court in the 2nd week of March, 2026.

At this stage, CRM (M) 2523 of 2025 is dismissed. Report submitted be kept with the record.
