Mr. Kaushik Dey, learned advocate for the petitioner being the Senior Intelligence Officer, Directorate of Revenue Intelligence submitted that at the stage when the revisional application was preferred, there was an order of interim bail in respect of the opposite party. Subsequently, the investigation has concluded and complaint has been filed before the jurisdictional court. Having regard to the present stage of the case and the petitioner having been granted bail in the year 2022 and there is no allegations as such of violating the conditions, I am of the view that the purpose and relevance for which the application for cancellation of bail was taken out has lost its force and relevance. As the complaint has already been filed before the jurisdictional court, let the trial of the case proceed in accordance with law. In case there is any non-cooperation from the side of the opposite party it would be the exclusive discretion of the trial court to impose stringent conditions, pass necessary directions and/or cancel the bail if the situation so warrants.

With the aforesaid observations, the cancellation of bail being CRM(SB)

286 of 2022 is disposed of.
