Learned advocate appearing for the petitioner submits that the petitioner is in custody in excess of 2 years and 11 months. Out of 25 charge sheeted witnesses, prosecution examined only 3 and, therefore, there is hardly any possibility of trial ending any time soon.

State and the defacto complainant are represented. Learned advocate appearing for the State draws the attention of the Court to the evidence of the prosecution, copies of which are annexed to the application for bail. He

submits that the petitioner and the co-accused were caught red handed with the victim in the room belonging to the petitioner along with the victim.

Considering the gravity of the offence and the involvement of the petitioner in the incident and the period of detention and the fact that prosecution now proposes to examine 12 more witnesses, we are not inclined to grant bail to the petitioner and the prayer for bail of the petitioner is rejected.

The application being C.R.M. (DB) 3870 of 2024 stands dismissed.
