Heard learned counsels for the parties.

The petitioner seeks a direction upon the 2nd respondent to consider the representation submitted by him on October 09, 2023.

It is submitted on behalf of the petitioner that pursuant to an order passed by this Court on September 29, 2023 in WPA No. 21825 of 2023 filed by one Atanu Ghosh directing the 2nd respondent therein to consider and dispose of the representation submitted by the said petitioner dated August 14, 2023, the concerned authority took up the representation for consideration and upon written submission made by the learned counsel for the petitioner before the authority, the next date of hearing has been fixed by the authority on November 30, 2023. Learned counsel for the petitioner herein seeks a direction upon the authority to deal with all the representations of similar nature submitted by the petitioner herein as well

as other petitioners at the same hearing upon deferring the hearing fixed on November 30, 2023.

Learned counsel for the respondents submits that the 2nd respondent be directed to consider the representation in accordance with law.

In view of the above, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the representation submitted by the petitioner dated October 09, 2023 along with the other representations on the same issue within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. Pending disposal of the representation, the petitioner shall continue to ply his vehicle in terms of the permit granted in his favour.

With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
