The criminal revision challenges the proceeding, being CR NO. 182 of 2009 pending before the learned Additional Chief Judicial Magistrate, Alipurduar and the order passed therein on 20th June, 2012.
The matter is pending for last 11 years. Hence, I propose to dispose of the matter based on materials made available with the record.
Upon perusal of the office report, particularly the report forwarded by the learned Additional Chief Judicial Magistrate, 2nd Court, Alipurduar, Jalpaiguri, I find that CR case no. 182 of 2009 was disposed of by this learned Additional Chief Judicial Magistrate on 29th December, 2020 where Rajmangal Shaw was convicted and Bimal Chowdhury was acquitted under Section 248 of the Code of Criminal Procedure. Binod Chowdhury alias Bimal Chowdhury is the petitioner
who has filed this application under Section 482 Cr.P.C.
In the given facts and circumstances, with the recording of an order of acquittal, this criminal revision has become infructuous.
Under such circumstances I am inclined to dismiss the criminal revision as infructuous. With the disposal of this criminal motion, all other connected applications stand disposed of. (Siddhartha Roy Chowdhury, J.)
