Ct. 10 Item No.84 & 85 01.03.2021 (suvendu) FMA 1887 OF 2018 With COT 73 OF 2017 Bajaj Allianz General Insurance Company Limited Vs.
Lakhiram Murmu & Ors.
Mr. Rajesh Singh ...............for the appellant Mr. Subir Banerjee Mr. Sandip Bandopadhyay ...............for the respondents.
Heard the parties.
Mr. Singh appearing on behalf of the appellant submits that this appeal is directed against an order dated 16th August, 2016 passed by the learned Judge, M.A.C. Tribunal (Addl. District Judge), Islampur in MACC No. 59 of 2012. He submits that the parties are agreeable to settle the matter amicably and a sum of Rs. 5, 14, 660/- by way of two separate deposits is lying with the Registrar General of this Court.
I find that there were six different claimants before the learned Trial court and the money should be distributed proportionately as directed in the impugned order.
The Registrar General of this Court is directed to pay the aforesaid sum along with
accrued interest to the claimants-respondents within a period of four weeks from date. The Registrar General will ensure physical presence of all the claimants-respondents and be satisfied about their identity upon proper and valid identification prior to making such payment.
Accordingly, FMA 1887 of 2018 and COT 73 of 2017 are disposed of in terms of the above. (Ravi Krishan Kapur, J.)
