The defendants in a suit for injunction and cancellation of sale Deed are the petitioners of the instant application under Article 227 of the Constitution of India, which is directed against the Order No. 30 dated August 31, 2023 passed by the Court of the learned Civil Judge (Senior Division) at Kalna, District - Purba Bardhaman, in the said suit being Title Suit No. 117 of 2022.

The learned Trial Judge by the order impugned has allowed an application for amendment of the plaint to incorporate the events which occurred subsequent to the filing of the suit. This Court does not find any reason to interfere with the order impugned.

However, time to file the additional written statement is extended for a further period of two weeks from date.

C.O. 4061 of 2023 is dismissed without any order as to costs. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
