Petitioner Mr. Anirban Mitra Mr. Amit Roy Ms. Madhumita Sadhukhan ... for the Petitioner The order dated 13.10.2023 reflects that the cost of Rs.20,.000/- was imposed upon the present petitioner. Mr. Mitra, ld. advocate for the petitioner, submits that earlier there was a direction in CRR 2430 of 2021 to fix at least a single date in each and every month so that the trial can be concluded at the earliest.

However, there being delay, the petitioner preferred an application under section 410 of the cr.p.c. It has been submitted that the cross examination of the prosecution witness is still continuing.

Under such circumstances, I direct that the ld. trial court would stick to the earlier order by fixing at least a single date on each and every month. No unnecessary adjournment be granted to either of the parties. All efforts thereto must be taken to conclude the trial by 31st of December, 2024.

So far as the cost which has been imposed by the ld. CJM, Purba Medinipur, Tamluk, the same be kept in abeyance. If there is no fault on the part of the present petitioner, the ld. JM, 3rd Court, at the end of the trial, would waive the same.

With the aforesaid observations, CRR 4476 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
