1. This revisional application has been filed with a prayer for early disposal of the maintenance case being M Case No. 218 of 2023 under Section 125 of the Code of Criminal Procedure pending before the Learned Judicial Magistrate, 1st Court, Barasat.

2. Considering the nature of prayer service of notice upon the opposite party stands dispensed with.

Learned counsel appearing on behalf of the petitioner has submitted that petition under Section 125 of the Code of Criminal Procedure was filed in the year 2023 and interim maintenance application is yet to be heard. It is further submitted that the Learned Trial Court is fixing the date every alternative six months. It is submitted that on the last date of hearing i.e. 18.03.2025, Learned Judge again adjourned the hearing of the interim maintenance application in the

month of September, 2025.

4. As a sequel, learned counsel appearing on behalf of the petitioner has prayed for at least early hearing of the interim maintenance application.

5. Regard being had to the all facts as well as having regard to all the copy of the orders annexed with the revisional application, I am of the humble view that Learned Magistrate may be requested to dispose of the interim maintenance application within a short period of time.

6. Learned Judicial Magistrate, 1st Court, Barasat is requested to dispose of the interim maintenance petition after affording the opportunity of hearing to both the parties as early as possible, preferably within one month from the date of communication of this order.

7. With the aforesaid observation, the revisional application stands disposed of.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.

9. All the parties shall act on the server copy of this order duly downloaded from the official web site of this Court.

Petitioner is at liberty to make communication of this order to the Learned Judicial Magistrate, 1st Court, Barasat.
