Petitioner is aggrieved by the fact that his complain which was addressed to the police authorities has not been acted upon. On 14.11.2024 report submitted by the State reflects that Bagnan PS Case No. 638 of 2024 dated 20.11.2024 has been registered for investigation under the relevant provisions of BNS, 2023.

Learned Advocate for the private respondents disputes the contentions made in the complaint and

submits that they have also filed a complaint under Section 163 of the BNS, 2023. Since the police authorities have already acted upon the rest of the issues. The contention relating to right, title and interest and possession of the property would be decided by the jurisdictional civil court, petitioner would accordingly approach the said Court. So far as the issues canvassed in the writ petition relating to the act and actions of the private respondents for which the complaint was communicated to the police authorities, the same has acted upon. As such, the purpose for which the present writ petition has been filed has been sub served.

Report submitted in Court be kept with the record. A copy of the report be handed over to both the parties.

Accordingly, WPA 27494 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
