Heard learned Advocates for both the parties. 2.

We have considered the materials on record. Complicity of the petitioners transpires from statement of co-accused before a police officer which is inadmissible in evidence. Investigation is complete. Under such circumstances, we are of the opinion custodial interrogation of the petitioners is not necessary and they may be granted anticipatory bail.

Accordingly, we direct in the event of arrest, the petitioners, namely, (1) Rasid Sk. @ Rashid Sk., (2) Sahen Sk. @ Sahin Sk., (3) Manowar Sk. @ Manowar Hossain, (4) Masadul Sk., (5) Gopal Sk. @ Golab Sk. & (6) Hasibul Sk. @ Hasibur Rahaman @ Sk., be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 Signed By : ARUP KUMAR DAS High Court of Calcutta 25 th of November 2024 05:08:44 PM
