The grievance of the petitioner is that the University declined to renew the affiliation to the college for the academic year 2022-2023.

It appears that the basic reason for not granting affiliation for the academic year 2022-2023 is lack of infrastructure in the laboratory of the college. It is submitted by the University that the Principal of the college has already superannuated and therefore, a new Principal is required to be appointed in his place. It has also been submitted by the learned advocate appearing on behalf of the University that despite several undertakings being furnished by the college to cure the deficiencies, it did not comply with same. The University gave repeated reminders to the college.

Mr. Partha Sarathi Bhattacharyya, learned Senior Advocate, appearing for the petitioner submits that the

college will cure both the deficiencies at the earliest. The college will appoint a new Principal and it will also upgrade the laboratory with the necessary equipment within a short period of time.

In the above facts, this writ petition is disposed of with the following orders: - The college will furnish an affidavit before the University within seven days from date giving an undertaking that it will appoint a new Principal within three months from date and upgrade the laboratory, as required by the University, within six months from date.

Upon such affidavit being furnished, the University will renew the affiliation to the college for the academic session 2022-2023 as an interim measure. If the college fails to comply with the undertakings, the University will be at liberty to cancel the affiliation. Accordingly, WPA 27214 of 2022 is disposed of. There will be no order as to costs.

Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
