Kausik CRM (M) 2528 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Purbasthali Police Station Case No. 214 of 2025 dated 21.07.2025 under sections 85/103(1)/80/3(5) of the BNS, 2023;

And In the matter of : Aloboddin Seikh ......Petitioner.

Mr. Dhananjay Banerjee Mr. Pralay Hazra ......for the Petitioner.

Mr. Md. Adil Badr Mr. Mia Begg ......for the State.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 131 days and he has been implicated in connection with the instant case as he happens to be the husband of the deceased.

Learned advocate submits that after 15 days of the incident the victim expired.

Learned advocate for the State opposes the prayer for bail and submits that in an inhuman manner with the belt, the deceased was assaulted by the present petitioner for which she succumbed to her injuries.

I have considered the post-mortem report, the nature of injuries and the period of time the deceased was admitted in the hospital and treated and thereafter she succumbed to the injuries.

I direct that the petitioner would be released on bail after the stage of consideration of charges are over by the learned Trial Court. The learned Trial Court would be at liberty to impose such terms and conditions as he deems fit and proper.

With the aforesaid observations CRM (M) 2528 of 2025 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
