Saha ...for the State This is an application wherein the petitioners have prayed for quashing of the FIR being No.55 of 2025 arising out of Belda P.S. Case No.55/25 dated 03.02.2025 under Section 126(2)/115(2)/351(2)/3(5) BNS and 3(1) (r ) (s) of the Scheduled Castes and the Scheduled Tribes ( Prevention of Atrocities) Act, 1989 presently pending before learned Additional Sessions Judge, 1st Court, Paschim Medinipur. Learned Counsel for the petitioners submits that opposite party no.

2, Susanta Sing informed Belda Police Station that the petitioners had threatened him on road on 1st February, 2025 on the issue of raising obstruction of the complainant's construction work and further allegation is that they have abused him with filthy languages mentioning his castes. Being aggrieved by the aforesaid proceeding, learned Counsel for the petitioners submits that accused Amit Kumar Pandit is an employee of University of Calcutta and attendance register of teacher for the month of February, 2025 goes to show that on that particular day, he was on duty in receiving answer scripts from the University.

accused Amit Kumar Pandit had committed any offence because the place of occurrence situates at a distance of more than 200 kms from his place of office.

Private opposite party is not represented.

Learned Counsel for the State submits that all the petitioners are FIR named and the injury report also discloses the name of the petitioners and he further submits that investigation is still continuing. Having heard learned Counsel for the petitioners and the State and since there is nothing to disbelieve the attendance certificate as well as the attendance register of teacher as submitted by the petitioners in respect of petitioner Amit Kumar Pandit, I find that it is not probable that said Amit Kumar Pandit is involved with the alleged offence. In such circumstances, let the investigation be continued in respect of other accused persons. However, the proceeding being Special Trial Case No.15/25 is quashed qua the petitioner, Amit Kumar Pandit. CRR 5128 of 2025 thus, stands disposed of.
