1. Report filed on behalf of the State is taken on record.

2. Learned counsel appearing for the petitioner submits that the only material available against the petitioner is the statement of a co-accused, which is inadmissible in evidence.

3. Learned counsel appearing for the State submits that apart from the statement of a co-accused, there are statements of independent witnesses who support the prosecution case. Those are present at pages 32,35 and 36 of the case diary. According to them, the petitioner was there at the time of occurrence, but fled away from the spot.

4. Considering the incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

5. Accordingly, the application for anticipatory bail is rejected.
