Ghosh ... for the Petitioner(s) Mr. Iqbal Kabir Ms. Ratna Ghosh ... for the State-respondent(s) Learned advocate for the petitioner submits that the subject-matter of the case relates to recovery of 50 bottles of phensedyl. However, the petitioner has been implicated in this case on the basis of the statement of a co-accused.

Learned advocate also submits that the petitioner is in custody for five months, as such, he prays that on any stringent condition, the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that the antecedents of the present petitioner do not call for any liberty to be granted to him during pendency of the trial.

Be that as it may, I have taken into account the quantum of seizure as also the fact that the petitioner has been detained because of the statement of a co-accused.

Having considered the same, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioners is Allowed.

Accordingly, the petitioner viz, Samiruddin Sk @ Samuraddin Seikh @ Juyala Sk shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act-cum-Additional Sessions Judge, 5th Court, Berhampore, Murshidabad.

If on bail, the petitioner shall make himself physically available on each and every date of the trial so fixed by the learned trial court and shall not leave the jurisdiction of the district of Murshidabad without the leave of the trial court. Accordingly, CRM(NDPS) 1546 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
