Pursuant to a notice issued by the Regional Transport Authority, Kolkata on 8th September, 2022 inviting applications along with requisite fees for certain bus/minibus routes under the jurisdiction of the Regional Transport Authority, Kolkata, the petitioner submitted an application along with requisite fees and also an eapplication before the authority on 16th March, 2023. The application is yet to be considered. The petitioner prays for a direction upon the authority to consider the application at the earliest. Learned counsel for the petitioner also submits that all requisite documents have been annexed to the application.
Learned counsel for the State respondents submits that the 2nd respondent be directed to consider the application filed by the petitioner subject to availability of the vacancy in the route.
In view of the above, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the application/e-application dated 16th March, 2023 within four weeks from the date of communication of this order
subject to availability of vacancy in the route, upon affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above observations and directions the writ petition is disposed of.
There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
