Learned advocate appearing for the petitioner is directed to serve copy of this revisional application upon Ms. Ratna Ghosh, learned advocate, who ordinarily appears for the State. Her appointment may be regularised by the concerned authorities.

Learned advocate appearing for the petitioner submits that on two occasions final report has been submitted by the investigating agency praying for discharge of the accused persons and expressing an opinion that no offence is made out. It has been submitted that a Naraji petition is pending before the learned Additional Chief Judicial Magistrate, Alipore in connection with Netaji Nagar Police Station Case No. 273 of 2017 dated 13.09.2017 and on the same date the proceedings under Section 138 of the Negotiable Instruments Act is also pending before the same court.

Be that as it may, if the petitioner at the time of hearing of the Naraji petition submits an additional prayer for considering his Naraji petition under Section 200 of the Code of Criminal Procedure, the learned court would consider the same in accordance with law.

With the aforesaid observations, the revisional application being CRR 4482 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
