Petitioner alleges that she is threatened by some persons including the neighbors and persons staying at adjacent apartments. It is further alleged that her window glass have been broken at the behest of some of the persons who are bent upon in disturbing her peaceful enjoyment of life.

Petitioner also submits that to that effect several complaints have been sent to the local police station as well as to the higher authorities.

Learned Advocate for the State submits a report. According to the State, there are number of criminal cases which are pending and investigation has been concluded also in some of the cases.

In view of the existing differences between the petitioner and the persons against whom it is complained, petitioner would be at liberty to bring the same to the notice of the Court which is in seisin of the criminal case. In case there is a fresh cause of action, petitioner would be also at liberty to file application under Sections

175(3)/223 of the BNSS before the jurisdictional criminal court. The jurisdictional criminal court will exercise its discretion while disposing of such complaints/ application.

In the meantime the police authorities would keep a strict vigil to ensure that there is no breach of peace in the locality.

With the aforementioned observations, the instant writ petition being WPA 27612 of 2024 is hereby disposed of.

Report be submitted be kept with the record.

Copy of the report be handed over to the learned Advocate appearing for the petitioner.

Parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
