Dan ... ...For the State As pointed out by the ld. advocate appearing for the petitioner that the next date is fixed on 18th of January, 2024, the investigating officer of the case is directed to be present in Court on 18th of January, 2024.

It has been informed that the chemical examination report has already been filed before the ld. Special Court in connection with NDPS Case No. 182 of 2022.

The ld. Special Court would exercise his power under section 311 of the Cr.P.C. there by calling for a competent officer from the State Drugs Control & Research Laboratory in respect of the chemical expert's report so submitted. The investigating officer will communicate the same to the State Drugs and Research Laboratory.

The superior officers are directed to communicate with the Director of the State Drugs and Research

Laboratory so that on the next date fixed before the ld. trial court, a competent officer should made available to explain the chemical expert's report, before the ld. trial court. The examination and cross-examination of the said witness be completed on the said date and whole of the prosecution evidence be completed by 15th of February, 2024.

The ld. trial court would fix dates for examination of the witnesses under section 313 of the cr.p.c. by the 1st of Week of March, 2024.

All efforts be taken by the ld. trial court so that the judgment is delivered by 30th of April, 2024. The Additional Superintendent of Police of Berhampore, Murshidabad will act as a nodal officer of this case and would ensure that the witnesses are produced on the date so fixed and no inconvenience is created to take the trial to its logical conclusion.

With the aforesaid observations, CRR 4484 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
