Ghosh ... for the Petitioner(s) Mr. Avishek Sinha Ms. Debadrita Mondal ... for the State-respondent(s) The petitioner was earlier granted bail, subsequently, he was absent on certain occasions and no steps were taken, as such, on 25th February, 2025, warrant of arrest was issued, subsequently, he was arrested and produced before the learned Special Court on 12.03.2025. It has also been contended that since then the petitioner is in jail custody.

Learned advocate for the State opposes the prayer for bail by pointing out the period of absconsion and noncooperation of the present petitioner. Having regard to the period of detention of the present petitioner, I am of the opinion that further custodial detention of the present petitioner is unwarranted.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Samaruddin Seikh @ Jowla Sk @ Jwala @ Samiruddin Seikh shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Court under NDPS Act-cum-Additional Sessions Judge, 5th Court, Berhampore, Murshidabad.

However, it is clarified that in this case for the purpose of local surety, the learned court will accept the title deed of a property of a person within the jurisdiction of the said police station, in which, the case was registered for investigation.

If on bail, the petitioner shall make himself physically available on each and every date of the trial so fixed by the learned trial court and shall not leave the jurisdiction of the district of Murshidabad without the leave of the special court.

Accordingly, CRM(NDPS) 1542 of 2025 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
