The grievance of the petitioners in the present writ application is that the original allottee of the flat being no. D-2/4, Scheme VIII-M was Smt. Gita Pan. Smt. Gita Pan has sub-leased the said flat to one Soma Dey. Subsequently, Soma Dey had entered into a deed of agreement for transfer with the wife of the petitioner namely, Sipra Samanta on September 22, 1997. After the death of Sipra Samanta, the wife of the petitioner, the petitioners have made several request to the KMDA (KIT wing) for transfer of the above mentioned flat in the name of the petitioners but till date the request of the petitioners had not been considered.

Learned counsel for the petitioners submits that lastly the petitioners have made the representation on November 11, 2025 which is appearing at page no. 33 being Annexure P7 of the instant writ application. Learned counsel for the petitioners submits that he will satisfy if this Court disposed of the writ application by directing the respondent no. 3 to consider the

representation of the petitioners for transfer of the flat no. D-2/4, Ultadanga Main Road, Kolkata in the name of the petitioners.

3. Learned counsel appearing for the respondents/authorities submits that if a direction is passed the authorities will consider the request of the petitioners and passed appropriate order in accordance with law.

4. Heard the learned counsel for the respective parties perused the materials on record.

The writ petition is disposed of by directing the respondent no. 3 to consider the request of the petitioner dated 11.11.2025 and after giving an opportunity of hearing to the petitioners and to pass a reasoned and speaking order within a period of eight weeks from the date of receipt of this order.

6. It is made clear that this Court has not gone into the merit of the matter. The respondent no. 3 is free to take appropriate decision without being influenced of any observation made in this order.

7. WPA 27321 of 2025 is disposed of.

8. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
