Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner had filed an FIR alleging cheating and forgery in the year 2021. Till now no charge sheet has been submitted. No effective investigation has been done in this case.

Learned counsel appearing on behalf of the private respondents denies the allegations made in the writ petition and submits that the dispute is civil in nature and there are suits pending.

Learned counsel appearing on behalf of the State relies on the report and submits as follows. Steps have been taken during investigation including seizure of articles and examination of witnesses. Notices were issued under Section 91 of Cr.P.C. Prayer was made to obtain documents from B.L.&L.R.O. and the office of the Sub-Registrar of Alipore. Shortly, a report in final form would be filed.

It is indeed quite surprising that for an FIR that was registered on 03.7.2021, till date neither a charge sheet nor a final report could be filed.

Let the further investigation of the case be continued, albeit under the supervision of Assistant Commissioner of Police, Belgharia, Barrackpore Police Commissionerate. Let the investigation of the case be concluded expeditiously and in accordance with law.

With these observations, WPA 26322 of 2023 is disposed of.
