1. This Court is not inclined to interfere with the order impugned. However, this Court is of the view that the IA No.4020 of 2024 should be disposed of expeditiously as the auction purchaser has been suffering since long. The sale certificate indicates that the auction purchaser has paid more than Rs.53 lakhs and an order of stay is operating, which has deferred the enjoyment of the property by the auction purchaser.

2. It appears that January 13, 2026 has been fixed for hearing of IA No. 4020 of 2024. The learned Debt Recovery Tribunal-III, Kolkata is requested to dispose of the said application within a month from the next date fixed without granting unnecessary adjournments to either of the parties. All points are kept open, to be decided by the learned court including the issues raised by the auction purchaser. This court has not made any observation on the merits of the pending applications.

3. Accordingly, the revisional application is disposed of.

4. Parties are directed to act on the basis of the server copy of this order.
