Learned advocate appearing for the petitioner submits that the petitioner has been implicated in this case on the basis of the statement of the co-accused and he is in custody for 145 days. It has been submitted that petitioner is innocent and as such he may be released on bail in view of the directions passed in CRM (NDPS) 1433 of 2025.

Learned advocate appearing for the State opposes the prayer for bail and submits that the petitioner happens to the registered owner of the vehicle and there are materials in support of the prosecution case that the contraband was being carried consciously and it was within the knowledge of the present petitioner.

Having considered the period of detention, the stage of the case and the provisions of Section 37 of the NDPS is attracted, I am not inclined to release the petitioner on bail. Accordingly, CRM (NDPS) 1544 of 2025 is dismissed at this stage.

Petitioner will renew his prayer for bail after the stage of consideration of charges is over.
