Learned counsel for the petitioner submits that the petitioners applied for electricity connection but the same was refused by the CESC Limited on the ground that there is a different pending application for electricity connection which is under process regarding the same premises.

Learned counsel for the CESC Limited hands over a copy of a communication dated February 17, 2023 made to the petitioners which indicates that it is extremely hazardous to have more than one source of supply for a particular unit as it may lead to fire and electrical hazards.

The CESC Limited also apprehends splitting of load in the event the petitioner gets a new connection at the premises, in view of existing electricity supply at the premises.

The document was evidently suppressed. Such conduct on the part of the petitioners is deprecated, since the document ought to have been disclosed in the writ petition.

Be that as it may, since an issue has been raised by the Distribution Licensee as regards the alleged splitting of load, the appropriate forum to decide the same is the concerned Grievance Redressal Officer (GRO).

Hence, WPA No. 26333 of 2023 is disposed of by granting liberty to the petitioner to approach the concerned GRO with the reliefs as sought in the present writ petition. If so approached, the GRO shall decide the dispute between the parties upon giving adequate hearing to all concerned and in accordance with law as expeditiously as possible, preferably within January 31, 2024.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
