Ejaz Akhter ... for the State-respondent(s) Learned advocate for the petitioner submits that although the subject-matter of the case relates to recovery of 361.9 gm of brown sugar, but, the case against the present petitioner is only restricted to the statement of a coaccused for which he has been implicated.

Learned advocate for the State submits that chargesheet has been submitted very recently and there are digital evidences pointing towards the present petitioner. Having considered the materials which have been relied upon by the State and the factum of commercial quantity of contraband, I am of the opinion that the rigours of Section 37 of the NDPS Act is attracted, as such, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Rejected.

Accordingly, CRM (NDPS) of is dismissed.
