1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Petitioner was an employee under Kolkata Port Trust, who was removed from service by order dated 29th January, 2018.

3. It is submitted by the learned advocate representing the petitioner that prior to his appointment in Kolkata Port Trust petitioner worked under Civil Defence. Prayer is made for releasing benefits including pension in connection with service rendered by the petitioner under Civil Defence.

4. However, nothing is demonstrated that petitioner worked substantively under Civil Defence thereby acquired right to receive

retiral dues including pension. If service of the petitioner under Civil Defence was pensionable service he could have lodged a claim after completion of service period under Civil Defence.

5. IGP & Controller of Civil Defence Kolkata, West Bengal vide memo dated 18th December, 2025 has reported that petitioner is not connected with Civil Defence and rendering service by the petitioner under Civil Defence is disputed. Memo dated 18th December, 2025 is taken on record.

6. In view of aforesaid scenario no relief can be granted to the petitioner.

7. Writ petition stands dismissed.

8. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
