Affidavit of service filed by the petitioner in Court today be retained with the records.

The petitioner submits that his daughter, born in the year 2022, is cent percent blind. The school where the petitioner is serving is approximately 786 kms. away from his residence. He seeks transfer. 3.

It appears that the petitioner is yet to make an application in the prescribed format seeking transfer. He has applied before the Commission of School Education seeking transfer on February 1, 2021, i.e., prior to the birth of his daughter. After the birth of his daughter, the petitioner is yet to make a formal application seeking transfer.

In view of the above, the instant writ petition stands disposed of with the observation that it will be open for the petitioner to make fresh application offline seeking transfer in the prescribed format before the head of the institution disclosing reason for the same.

The head of the institution shall consider the prayer of the petitioner in accordance with the prevailing transfer rules.

If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken by the authority at the earliest but positively within a period of eight weeks from the date of filing of the application. 7.

The fate of the petitioner's application shall be made known to the petitioner immediately thereafter. 8.

Suspension of the Utsashree portal will not stand in the way of the authorities from taking steps in terms of the order passed hereinabove.

The writ petition stands disposed of.

Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
