Petitioners have approached this Court complaining that there has been interference by the private respondents in respect of peaceful possession of the petitioners.

State has submitted a report which reflects that Title Suit No.123 of 2022 is pending and there has been direction of maintaining status quo in respect of the said property. Additionally, in the police report it has been contended that on local enquiry it could be learnt that there was no new construction in the disputed land.

In view of the nature of the dispute and difference which is before the civil court, the right, title and interest of the property would be decided by the civil court itself. Police authorities would only

ensure that there is no breach of peace and/or tranquility and or any untoward incident resulting because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 27609 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioners. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
