Barun Das v. State Of West Bengal
02.12.2025 Court No.35.
D/L. 57.
Rakib (Rejected) CRM (M) 2539 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Ghola Police Station case no. 540 of 2022 dated 17.09.2022 under Sections 448/325/307/34 of the Indian Penal Code, 1860. And In the matter of : Barun Das.
......Petitioner.
Mr. Dhananjay Banerjee Mr. Pralay Hazra ......for the Petitioner.
Ms. Baishali Basu Ms. Nirupam Dhali ......for the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for one year seven months and has been falsely implicated in connection with the instant case. There are hardly any possibilities of the trial being concluding very soon, as such the petitioner may be released on bail. Learned advocate for the State on the other hand produces the Case Diary and submits that petitioner is a principal accused who has inflicted vital blow. Records reflect that the case is at the stage of consideration of charges but the same is delayed for other accused persons evading the Court.
Consequently, I direct the learned trial Court that after the stage of consideration of charges is over the learned trial
Court will release the petitioner on bail on such terms and conditions as he deems fit and proper for ensuring the presence of the present petitioner.
With the aforesaid directions CRM (M) 2539 of 2025 is disposed of.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
