In this public interest petition the petitioners have made an allegation that in respect of project of construction of Kangsabati River Bandh the embezzlement of fund has been done and false master rolls have been prepared without doing any project work.
Learned counsel for the petitioners has submitted that earlier the petitioners had filed WPA 13008 of 2021 which was disposed of by the learned Single Judge dated 19.01.2022 by permitting the petitioners to lodge a complaint before the authorities in accordance with law and with a direction that the same will be considered. He submits that petitioners thereafter had filed the complaint dated 15.03.2022 before the respondent no.3 i.e. District Magistrate, Paschim Medinipur, but till now no action has been taken. In spite of service of notice, no one is present on behalf of the State and the other respondents. In the facts and circumstances of the present
case, we are of the opinion that the complaint, which was made by the petitioner on 15.03.2022 to the respondent no.3, needs consideration by the said respondent.
Hence, we dispose of the present public interest petition by directing the respondent no.3 to duly consider the complaint dated 15.03.2022 in accordance with law as expeditiously as possible preferably within a period of two months from the date of receipt of a copy of the order. If found necessary while deciding the complaint, the respondent no.3 will conduct the local enquiry.
The petition is accordingly disposed of.
