On November 28, 2024, this Court passed the following order:

"The learned advocate representing the bank does not dispute that an OTS agreement was reached on December 6, 2023, for the amount of Rs. 19,59,006 (Rupees nineteen lakh fifty-nine thousand and six), after adjusting the payment made by the petitioner.

In light of the above, there shall be a stay on further auction proceedings for a period of two months from the date of this order, provided the petitioner pays Rs.10,00,000 (Rupees ten lakh) within 15 days from the date of this order, and an additional Rs.10,00,000 (Rupees ten lakh) within the following 30 days. In the event of default, the interim stay granted by this Court shall automatically stand vacated.

This matter shall be listed again after four weeks under the same heading."

It is not disputed that the petitioner has not been able to pay any amount after the order dated November 28, 2024.

Learned advocate appearing for the petitioner, however, seeks further extension of time for making the deposit.

In view of the conduct of the writ petitioner, I am not inclined to grant such prayer.

Accordingly, WPA 27628 of 2024 along with CAN 1 of 2024 is dismissed.
