For the Respondent nos. 4-6 Affidavit of service filed by the petitioners and the report submitted by the State are taken on record. The only prayer of the petitioners in the writ petition is for returning to their house from where they have been allegedly driven out. Admittedly the house in question is the ancestral house of the first petitioner and the second petitioner is his wife. This Court is informed that the 4th respondent who is the daughter in law of the petitioner has been residing in the said house. A complaint was lodged by the son of the petitioners which was registered as FIR and charge sheet submitted upon completion of investigation. The complaint lodged by the fourth respondent is also pending.

Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that since the petitioners seek to return to their house and stay there peacefully, the Officer in charge of the Jamalpore police station being the 3rd respondent herein is directed to render necessary assistance to the petitioners in order to enable

them to return to their house. They shall intimate the third respondent the date and time of their proposed return to the house. The third respondent shall render all possible assistance to them so that they are able to enter their house peacefully without any obstruction.

The police authority shall also provide assistance/protection to the petitioners so that they are able to reside therein without any disturbance from any corner whatsoever.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
