Kausik (Allowed) CRM (M) 2570 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Gazole Police Station Case No. 257/2025 dated 14.03.2025 under section 6 of the POCSO Act.

Report submitted by the State be kept with the record. Learned advocate for the petitioner has handed over the deposition of the victim.

I have taken into account the statement of the victim as appearing in the case diary. Also having regard to the fact that deposition of the victim presently is over and the other witnesses are to be examined and the petitioner is in custody for about 8 months, I am of the view further detention of the petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Joychand Barman shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Court under POCSO Act cum Learned Additional District and Sessions Judge, 2nd Court, Malda.

If on bail the petitioner shall be physically present on each and every date before the learned Trial Court and shall not enter the jurisdiction of Gazole Police Station without the permission of the learned Special Court. Petitioner shall also not leave the District of Malda without prior permission of the learned Special Court and inform his address to the local Police Station where he would be residing. A copy of the address where the petitioner would be residing be furnished to the learned Special Court for further action, if required. With the aforesaid observations CRM (M) 2570 of 2025 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
