1. Affidavit of service filed in Court today is taken on record.

2. The petitioner is a teacher of Persian (PG) subject. His allegation is that the Commission did not disclose the vacancy in the subject Persian in the advertisement floated for recruitment of assistant teachers in the year 2025.

3. From the document annexed to the writ petition, it appears that the West Bengal Board of Secondary Education has declared that there is already one vacancy of the subject Persian and the same is reserved for Scheduled Caste Category candidate.

4. The petitioner is a member of the General Category. Submission is that one extra seat ought to be kept aside for the General Category candidates in the subject Persian.

5. According to the State, the 100-Point Roster has been followed and the first vacancy in the 100-Point Roster is reserved for the Scheduled Caste Category. There is no further vacancy in the subject Persian.

6. The prayer of the petitioner for declaring fresh vacancy in the Persian subject in the General Category cannot be allowed by the Court. It is for the authority to declare vacancy and the Court exercise power of judicial review in such a situation.

7. The writ petition fails and is hereby dismissed.
