Dey ...for the State Mr. Shivaji Kumar Das ...for the added respondent Learned counsel appearing on behalf of the petitioner submits that her client does not want to press this matter as there are some incurable defects in the same. She wants to withdraw the same with liberty to file afresh. In view of the above, the petitioner is granted liberty to withdraw the writ petition.

Accordingly, the same is dismissed as withdrawn. However, this order shall not preclude the petitioner from filing a proper application afresh on the self-same grounds.
