1. The petitioner being a public interest litigant and a resident of a particular area alleges that notification issued by the Transport Department, Government of West Bengal dated 20.05.2003 fixing the maximum number of stage carriage permits that can be granted, fresh permits are to be granted without considering the fact that the entire area is congested and it will not be in a position to accommodate any more stage carriages.

2. Learned counsel representing the State points out that the existing operator has filed a writ petition being WPA 10057 of 2024 in which a report has been called for and the matter is pending. Since the existing operators has already moved the learned writ court, we dispose of this writ petition giving liberty to the present writ petitioner, Mr. Suman Roy to intervene in the writ petition being WPA 10057 of 2024 and place necessary documents to assist the Court to take a decision in the matter.
