The petitioners have been accused in connection with Mothabari Police Station Case No. 446 of 2022 dated 17.11.2022 under Sections 328/34 of the Indian Penal Code. Learned advocate for the petitioners submits that warrant of arrest has been issued against the petitioner. A copy of the revisional application may be served upon Mr. Nandy, learned Additional Public Prosecutor who usually appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. He is entitled to have a junior of his choice.

In view of the warrant of arrest being issued and as submitted that the anticipatory bail application being already rejected, I direct that, as submitted, in case the petitioner surrenders before the learned Chief Judicial Magistrate, Malda, the learned C.J.M, Malda

will call for the case diary and thereafter consider the application for bail of the petitioner in accordance with law. . Accordingly, the present revisional application being CRR 4519 of 2022 is disposed of.
