Mr. Ayan Bhattacharjee, Mr. Kunal Ganguly, Mr. Tirupati Mukherjee ...for the petitioner. Mr. Arun Kumar Maity (Mohanty), Mr. Bibekananda Sinha Roy ... for the C.B.I. The petitioner is not named in the F.I.R. His name did not appear in the first supplementary charge-sheet but was included in the second supplementary charge-sheet filed in 2022.

The petitioner is accused of being involved in a ponzi scam. He is in custody for 87 days. Some co-accused have already been released on bail.

However, Mr. Maity, learned advocate for the Central Bureau of Investigation very seriously contends that the petitioner should be kept in custody considering the nature and gravity of the offence and his power to influence the witnesses.

Considering the fact that the alleged offence is of 2014 and other factors stated above, let whatever pending investigation be carried out by the Central Bureau of

Investigation by 31st January, 2023 while the petitioner is in custody.

On and from 1st February, 2023 the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Paschim Bardhaman on the following conditions:

1. The petitioner shall deposit his passport with the investigating officer,

2. He shall report before the said officer as and when summoned,

3. The petitioner shall not leave the limits of Paschim Bardhaman without informing the I.C.,

4. He shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever,

5. The petitioner shall attend the court on each and every day of trial, in default, the court shall be at liberty to cancel the bail bond without any reference to this bench.

The application for bail [CRM (DB) 4380 of 2022] is, accordingly, disposed of.
