The petitioner is an approved Assistant Teacher of Bhojerhat Sarada Deshapriya Balika Vidyalaya, she is praying higher scale of pay on enhancement of her qualification in the relevant subject.
The petitioner is alleging that the Managing Committee of the school by a resolution allowed her to pursue the course of Master's Degree and had communicated the said resolution to the District Inspector of Schools (SE), District: 24 Parganas (South), the respondent no. 4 herein but the said respondent did not respond to the said communication. The petitioner claims that she has completed her Master's Degree in Physics from Madurai Kamraj Open University through distance learning without affecting the learning process of the students of the school.
A representation of the petitioner dated September 7, 2023 praying such higher scale of pay is pending consideration before the respondent no. 4, the
said representation is appearing at page 76 of the writ petition being Annexure P-17.
The said respondent therefore is directed to consider and dispose of the said representation of the petitioner expeditiously in accordance with law, preferably within a period of four weeks from the date of communication of this order, after giving the petitioner and the school authority an opportunity of hearing.
The petitioner is required to serve a complete copy of the writ petition upon the respondent no. 4 afresh.
WPA 26375 of 2023 is thus disposed of with the above terms without any order as to costs. Parties to act on server copy of this order duly downloaded from the official Website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
