Mahata ..for the State The petitioner alleges that the Krishnarampur Gram Panchayat did not accept the filled in form with relevant documents which the petitioner wanted to deposit in the office of the concerned gram panchayat in order to obtain sanction for raising a construction on L.R. plot no.3804 pertaining to L.R. Khatian no.7883 of mouza Krishnarampur. Hence, the writ petition has been filed seeking directions upon the panchayat authorities to accept the papers relating to grant of sanction in favour of the petitioner. The petitioner is confused as to whether the permission granting authority would be the Zilla Parishad or the gram panchayat.

This writ petition is disposed of with the following directions :- A) First, the petitioner will ascertain as to who would be the permission granting authority.

Thereafter, if the petitioner applies in the prescribed form before the permission

granting authority with necessary documents and complies with all legal formalities, the said papers shall be accepted by the authority.

B) The application for sanction shall be processed in accordance with law. If there are any defects, the petitioner will be notified of the same.

C) In the event, the petitioner removes the defects and rectifies the mistakes or errors, the sanction shall be issued strictly in accordance with law.

D) If there are any reasons for not granting the said sanction, such reasons shall be disclosed in the order.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are to act on the basis of the server copy of this order.
