Report filed by the State is also taken on record. A copy of the same is handed over to learned counsel for the petitioners.

Learned counsel for the petitioners submits as follows. The petitioners' son had gone missing in 2022, pursuant to which the petitioners lodged a complaint being Gosaba Police Station Case No.195/22 dated 08.11.2022 under Section 365 of the Penal Code. Till date the whereabouts of the petitioners' son have not been intimated by the police.

Learned counsel for the State relies on the report and submits as follows. It was found from the investigation that the alleged victim had gone to his inlaws' place out of own volition. His statement was recorded under Section 164 of the Code. Accordingly, a final report was filed as mistake of facts dated 31.12.2023.

In view of the fact that the missing person had himself given a statement that he was staying somewhere else out of his own volition and a final report has been submitted in the case, no further order need be passed in this regard.

With these observations, the writ petition is disposed of without any order as to costs.
