The present revisional application was preferred challenging the order dated 24-11-2022 passed in complaint case No. 67C of 2007 which is pending before the learned Judicial Magistrate, 4th court, Howrah. I have checked the order passed by the learned Magistrate assigning the reasons for closing the defence witness and fixing date for final arguments of the case. Having considered that the case is of the year 2007 and the intention of the legislature in similar set of proceedings, I am not satisfied with the submissions/contentions and/or stand taken by the accused.
Learned advocate for the petitioner has submitted that since the final arguments of the case have not been concluded, an opportunity be granted to the petitioner.
Having considered the frustration expressed by the learned trial court, I am not inclined to accept such prayer. If the final
verdict has not been delivered till date, the learned Magistrate will pronounce his final verdict in the case by 31st August, 2023. With the aforesaid observations, the present revisional application being CRR 4524 of 2022 is disposed of. All Pending applications, if any, are disposed of accordingly.
