The petitioners seek for a direction upon the respondents for making an enquiry by a competent authority and to take steps for demolishing the unauthorised construction for removing the mobile tower.

Learned advocate for the petitioners submits that the Chairman, Panihati Municipality has taken on file the complaint made by the petitioners and has fixed a date of hearing on 17.08.2023.

In the light of the above, we direct the Chairman, Panihati Municipality to hear all the parties, namely, the petitioners, the private respondents and the eighth respondent and after hearing the submission of the parties, a speaking order be passed on merits in accordance with law.

With the above direction, the writ petition is disposed of.
