Petitioner is aggrieved by the fact that in spite of partition suit pending before the appropriate civil court, he is being obstructed from carrying out cultivation of his own land and the same is in violation of the injunction order passed in T.S.91 of 2021.

Learned advocate for the private respondent nos.5 to 8, on the other hand, disputes and denies the contentions and submits that the respondents had been cultivating in their own property.

State has submitted a report. Report reflects relating to the civil suit pending, proceedings being drawn up under Section 107 of the Cr.P.C. and a long standing land dispute existing between the petitioner and the private respondents.

Having considered the nature of the accusations, I direct that the police authorities will only interfere if there is violation of law and order. With the aforesaid observations, WPA 27659 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Copy of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
