Heard learned counsels for the parties.

The petitioner has been granted permanent permit for plying his vehicle from Rampurhat to Dumka. The petitioner raised objection against the counter-signature in the permit issued in favour of the private respondent on an allegation of fraud, malpractice and mis-representation on the part of the said respondent.

Pursuant to a representation submitted by the petitioner in this regard before the concerned authority on 27th September, 2022, hearing was fixed by the authority on 1st December, 2022. The petitioner appeared before the authority on that date and sought adjournment. It is submitted on behalf of the petitioner that no further hearing has been conducted by the authority till date.

Upon consideration of the submission made on behalf of the parties, the writ petition is disposed of directing the concerned authority, being the 3rd respondent herein, to consider and dispose of the representation submitted by the petitioner dated 27th September, 2022 within two weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all the interested parties including the petitioner and the private respondent, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above observations and directions this writ petition being WPA 27344 of 2022 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
