Affidavit of service filed in Court is taken on record. Learned advocate for the petitioner submits as follows. The Punjab National Bank has started a fraudulent scheme under the Pradhan Mantri Mudra Yojna Tarun for duping unsuspecting investors.

Representations were made to different authorities, but there was no response.

Learned advocate for the Bank points out that no representation has been made to the local police authorities.

It does not appear that a complaint has been made by the petitioner to the local police station alleging commission of cognizable offence. The question of transferring the matter to CBI or any other investigating agency comes much later.

The petitioner shall be at liberty to approach the local police station with a letter of complaint. In case an FIR is not registered, the petitioner shall be at liberty to

follow the steps in terms of ratio laid down in Aleque Padamsee's case reported at (2007) 6 SCC 171. No further order need be passed in this regard. With these observations, the writ petition is disposed of without any costs.

As affidavits were not called for, the allegations made are deemed not to have been admitted.

Urgent certified copies of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
