The present revisional application has been preferred praying for expeditious disposal of the application under Order 39 Rule 1 & 2 of CPC filed by the plaintiff/petitioner herein in Title Suit No.357 of 2021 pending before the court of the learned Civil Judge, Junior Division, 1st Court, Kandi, Murshidabad.

Considering the nature of relief prayed for service is dispensed with.

It appears that the suit before the trial court is a suit for declaration and injunction.

Considering that the application under Order 39 Rule 1 & 2 is pending since the year 2021, the revisional application is disposed of with the direction that the trial court shall make all endeavour to dispose of the application under Order 39 Rule 1 & 2 of CPC in accordance with law preferably within a period of two months from the date of this order and

also make all endeavour to dispose of the suit expeditiously.

The revisional application being CO 4001 of 2024 stands disposed of.

Urgent Xerox certified copies of this order, if applied for, shall be supplied to the learned counsel for the parties as expeditiously as possible, in compliance of usual formalities.
